Overview
This issues paper on Crisis Management under the Deposit Takers Act 2023 sets out key issues for operationalising the crisis management regime in the DTA. In particular, it discusses:
- a staged response to managing deposit takers in different levels of financial distress or other difficulties
- potential updates to our existing resolution tools, including those used to help recapitalise a failed deposit taker without relying on public funds
- whether there is any need for additional statutory provisions to facilitate recapitalisation (so called, 'bail-in')
- potential requirements for crisis management preparation in a business-as-usual environment.
