In 2024 we sought feedback on an Issues Paper on Crisis Management under the Deposit Takers Act 2023 (DTA). Thank you to those who participated in the consultation.  

The consultation closed on 22 November 2024. We received 7 submissions.  

The submissions are available below. We are considering the submissions as we undertake policy development and planning related to the implementation of the new crisis management framework. We intend to release a summary and response to submissions, and clarify timelines for our work programme, in due course.

Overview

This issues paper on Crisis Management under the Deposit Takers Act 2023 sets out key issues for operationalising the crisis management regime in the DTA. In particular, it discusses: 

  • a staged response to managing deposit takers in different levels of financial distress or other difficulties
  • potential updates to our existing resolution tools, including those used to help recapitalise a failed deposit taker without relying on public funds
  • whether there is any need for additional statutory provisions to facilitate recapitalisation (so called, 'bail-in')  
  • potential requirements for crisis management preparation in a business-as-usual environment.
